TERMS AND CONDITIONS

1. SCOPE
These Terms and Conditions are valid for all quotations, goods and services rendered through the SOFRI Internet Shop www.sofri.rs. The customer accepts the Terms and Conditions by submitting an order as a fixed component of the contract. Terms and Conditions of customers are considered to be null and void.
2. CONTRACTING PARTY
With any purchases made through the SOFRI Internet shop www.sofri.rs, the customer enters into a contract with Fritz Kosmetik Großhandels GmbH, Ameisgasse 65, 1140 Wien, Austria (“SOFRI”) as the seller.
3. QUOTATIONS AND SIGNING OF A CONTRACT
3.1 All quotations in the SOFRI Internet Shops www.sofri.rs are subject to confirmation.
3.2 By placing an order the customer submits an offer to purchase, which SOFRI is not obliged to accept. SOFRI is currently accepting orders from these countries. SOFRI will confirm the receipt of the offer by email (confirmation email). This email does not constitute acceptance of the offer. The customer is requested to check the accuracy and completeness of the order confirmation and to report any discrepancies to SOFRI as soon as possible in order to avoid incorrect deliveries.
3.3 SOFRI may accept the customer’s offer by sending a further email confirming a formal contract and/or by sending the ordered goods to the customer. The contract of sale comes into being with the acceptance of the offer.
4. DELIVERY CONDITIONS
4.1 Delivery is effected via DPD to the address supplied by the customer. Deliveries are currently possible to addresses in these countries.
4.2 Deliveries are routinely carried out within five working days. SOFRI will indicate longer delivery times in the product description. In the event of delays in delivery of over one week, SOFRI will inform the customer by email. Should certain products be out of stock SOFRI reserves the right to make partial deliveries. No delivery costs will be charged for the delivery of the out of stock products.

5. PRICES, DELIVERY COST, PAYMENT CONDITIONS
5.1 Prices of all products in the SOFRI Internet Shops www.sofri.com include all taxes, unless otherwise stated, excluding delivery costs. The quoted prices are valid until a new price list is issued. Shipping and delivery costs can be found on the page Shipping costs at any time, and are displayed in the order summary before the order is completed.
5.2 Agreement regarding costs for returned goods: if the customer makes use of his right to cancel an order, all costs incurred for the return are for his account.
5.3 SOFRI will inform the customer of their acceptance of the order and will send an invoice by return. The invoice amount is due on presentation unless otherwise agreed.
5.4 The terms of payment are dependent on the payment method selected by the customer. Customers can choose to pay by pre-payment, SOFORT-Überweisung (immediate transfer), Visa, MasterCard or PayPal. Payment on delivery is only possible for orders from Austria and Germany. You will find the COD costs here.
5.5 The customer is liable for all out of pocket expenses e.g. bank cancellation charges etc. as well as charges resulting from – for example – incorrect credit card details, incorrect bank account details, insufficient funds or a wrongful reversal of funds.
6. WARRANTY AND LIABILITY
6.1 The warranty is based on legal regulations.
SOFRI is only liable for damages caused to the customer in a case of deliberate or gross negligent action on their part or one of their designated agents, regardless of any circumstance and legality especially with regard to possible consequential damage and claims of third parties. This excludes liability of damage to persons and claims in respect of the product liability law.
7. FINAL CLAUSES
7.1 Place of performance is Vienna.
7.2 The contract is subject to Austrian law excluding the application of the UN Convention on Contracts for the International Sale of Goods.
7.3 The contract language is German.
7.4 The customer has the means to view all online purchases made in the SOFRI Internet Shop www.sofri.com after registering his user account. The contract text is not stored.
7.5 The sole place of jurisdiction is the inner city of Vienna. § 14 of the Austrian Consumer Act will form the basis of any legal actions against consumers.
